Welcome to CUDO Compute’s Terms of Service. These Terms govern your access to and use of CUDO Compute services, including the CUDO Compute website, customer portal, APIs, infrastructure services, and any related support or managed services provided by CUDO Compute.

These Terms are designed to provide clear information on how our services operate, the responsibilities of each party, and the terms that apply when you purchase or use our services.

Our Services

CUDO Compute provides infrastructure services for AI and high performance workloads, including access to compute environments, deployment services, and related support services, as described in the applicable Order Form, Service Terms, Statement of Work, or Service Level Agreement.

Depending on the services selected, this may include:

  • Dedicated GPU clusters
  • Private cloud infrastructure
  • Bare metal environments
  • Storage and networking integrations
  • Deployment and commissioning services
  • Monitoring, support, and operational services
  • Access through the customer portal or API

Contract Documents

Your agreement with CUDO Compute may consist of one or more of the following documents:

  • These Terms of Service
  • Order Form or commercial agreement
  • Service Terms
  • Service Level Agreement (SLA)
  • Acceptable Use Policy
  • Privacy Policy
  • Data Processing Addendum (where applicable)
  • Statement of Work (where applicable)

If there is any inconsistency between documents, the Order Form or signed commercial agreement will take priority, followed by any Service Terms or SLA, then these Terms.

Eligibility

You may only use our services if you are legally able to enter into a binding contract on behalf of yourself or the organisation you represent.

Use of Services

You must use the services in accordance with:

  • These Terms
  • Applicable laws and regulations
  • The Acceptable Use Policy
  • Any technical or operational requirements communicated by CUDO Compute

You are responsible for your workloads, applications, data, user access controls, and all activity carried out under your account.

Service Changes

We may improve, modify, replace, or discontinue aspects of the services from time to time. Where changes materially affect contracted services, we will provide reasonable notice where appropriate.

Fees and Billing

Fees, billing terms, payment schedules, renewal terms, and any commitment periods will be set out in the applicable Order Form or commercial agreement.

Support and Service Levels

Where support commitments or uptime commitments apply, these will be set out in the relevant SLA or service documentation.

Suspension and Termination

We may suspend or terminate services where reasonably necessary for security, non payment, legal compliance, breach of contract, or material misuse of the services, subject to the applicable agreement terms.

Data Protection

We process personal data in accordance with our Privacy Policy and any applicable data protection agreement.

Governing Law

Unless otherwise agreed in writing, these Terms are governed by the laws of England and Wales.
